Privacy Notice

This privacy notice is issued by the Education and Skills Funding Agency (ESFA) on behalf of the Secretary of State for the Department of Education (DfE) to inform learners about the Individualised Learner Record (ILR) and how their personal information is used in the ILR. Your personal information is used by the DfE to exercise our functions under article 6(1)(e) of the UK GDPR and to meet our statutory responsibilities, including under the Apprenticeships, Skills, Children and Learning Act 2009.

The ILR collects data about learners and learning undertaken. Publicly funded colleges, training organisations, local authorities, and employers (FE providers) must collect and return the data to the ESFA each year under the terms of a funding agreement, contract or grant agreement. It helps ensure that public money distributed through the ESFA is being spent in line with government targets. It is also used for education, training, employment, and wellbeing purposes, including research. We retain ILR learner data for 3 years for operational purposes and 66 years for research purposes. ILR data is shared with third parties where it complies with DfE data sharing procedures and where the law allows it. The DfE and the English European Social Fund (ESF) Managing Authority (or agents acting on their behalf) may contact learners to carry out research and evaluation to inform the effectiveness of training.

At HTP Apprenticeship College we like to show our pride in our learners and as part of this we often generate material about their successes, progress and opinions. This material may include photographs or film, case studies or other stories and may be generated by our staff or other assigned persons such as photographers, videographers, designers and copywriters, which we may then use in various digital or print communications for publicity and/or marketing purposes.

These communications could include but may not be limited to: our publications, leaflets, internal and external display material, emails, our website, or social media channels. We may also send the material to other publications or media channels, including news media. We require your permission to do this. 

I agree to the use of material generated of or about me, in publicity or promotional communications as above, produced by HTP and in any publicity or promotional communications about our services sent to other organisations including news media. I understand that websites and other online media can be seen both inside and outside the UK.

Copyright

I understand that I have no copyright claim to the material unless I have generated it myself – in which case by supplying it to HTP I grant permission for its use in the ways outlined above.

I understand that my consent will be recorded on our learner information system and that I can ask HTP to stop using the material at any time, in which case efforts will be taken to prevent it being used in future communications but it may continue to appear in items which are already in circulation.
